The short version: Days Gone By is a free app for keeping track of dates. Use it however you like for personal purposes. Your data is yours and stays on your device — which also means backing it up is your responsibility. The app is provided as-is, without warranty.

1. Agreement

These Terms govern your use of the Days Gone By mobile application ("the app"), published by Bill Harned ("we", "us"). By downloading, installing or using the app, you agree to them. If you do not agree, please do not use the app.

2. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple devices you own or control, as permitted by the App Store Terms of Service. This licence is for your own personal, non-commercial use.

3. What you may not do

Copy, modify, translate, or create derivative works from the app.
Reverse engineer, decompile, or disassemble it, except where that right cannot lawfully be restricted.
Rent, lease, lend, sell, sublicense, or redistribute it.
Remove or obscure any proprietary notice within it.
Use it for any unlawful purpose, or to store unlawful content.

4. Your content

The events, photos, notes and categories you add are entirely yours. We claim no ownership of them and, as described in our Privacy Policy, we have no access to them. You are responsible for the content you add and for having the right to use any photo you attach.

5. Backups are your responsibility

Because your data lives on your device rather than on our servers, we cannot recover it for you. If you delete the app, lose or reset your device, or delete an event, that data may be gone permanently. We strongly recommend keeping an iCloud or iTunes backup of your device, and switching on the app's optional iCloud sync if you want your events to persist across devices.

6. Availability and changes

We may update, change, or discontinue the app or any of its features at any time, with or without notice. Updates may be required for the app to keep working correctly. We are not obliged to provide any particular update, support, or maintenance.

7. Cost

The app is currently offered free of charge. Should any paid feature be introduced in the future, its price and terms will be disclosed clearly before you buy, and any purchase would be processed by Apple under the App Store's terms — not by us.

8. Third-party services

The app runs on Apple platforms and can use Apple's iCloud service if you enable sync. Your use of those services is governed by Apple's own terms and privacy policy. We are not responsible for Apple's services, nor for any interruption, loss, or change affecting them.

9. Disclaimer of warranty

The app is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, accurate, or that it will meet your requirements.

Days Gone By is a convenience tool for remembering dates. Do not rely on it as the sole reminder for anything with legal, medical, financial, or otherwise serious consequences.

10. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of data, profits, goodwill, or memories, arising out of your use of or inability to use the app — including a missed event or a lost photo — even if advised of the possibility. Where liability cannot be excluded, it is limited to the amount you paid for the app, which for a free app is zero.

Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you. Nothing here limits any right you have under mandatory consumer protection law.

11. Apple

These Terms are between you and us, not with Apple. Apple has no obligation to provide any maintenance or support for the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation regarding the app. Apple is a third-party beneficiary of these Terms and may enforce them against you.

12. Termination

This licence lasts until terminated. It ends automatically if you breach these Terms, and you may end it at any time by deleting the app from your devices.

13. Governing law

These Terms are governed by the laws of the United States and of the State of Ohio, without regard to conflict-of-law principles, except where the mandatory law of your country of residence requires otherwise.

14. Changes to these Terms

We may revise these Terms from time to time. The current version will always be posted on this page with its date. Continuing to use the app after a change means you accept the revised Terms.
